Damage to Property and Engineer Liability – JOBSUB LTD – ENGINEER TERMS & CONDITIONS
1. INTRODUCTION
These Engineer Terms & Conditions (“Terms”) govern the relationship between Jobsub Ltd (“Jobsub”, “we”, “our”, or “us”) and the self-employed engineer or tradesperson (“Engineer”, “you”, or “your”).
By registering with Jobsub, accepting work, or clicking “I Agree” within the Jobsub application, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

3. SELF-EMPLOYED STATUS
The Engineer acknowledges and agrees that:
• they are an independent self-employed contractor;
• nothing in these Terms creates an employment relationship, partnership, joint venture, or agency relationship;
• they are solely responsible for their own tax, National Insurance, VAT, pensions, and other statutory obligations;
• they are responsible for providing their own tools, equipment, transport, insurance, licences, and certifications.
The Engineer has no authority to enter into contracts on behalf of Jobsub.

4. ENGINEER REQUIREMENTS
The Engineer agrees to maintain:
• all necessary qualifications and certifications relevant to their trade;
• valid public liability insurance of not less than £1,000,000;
• any legally required licences;
• compliance with all applicable laws and regulations.
The Engineer must immediately notify Jobsub of any changes affecting their ability to perform work.

5. JOB ALLOCATION
Jobsub may offer work opportunities through its app, telephone system, or other communication channels.
Jobsub does not guarantee any minimum volume of work.
Engineers remain free to accept or decline work opportunities unless otherwise agreed.
Acceptance of a booking creates a commitment to attend and complete the work professionally.

6. CUSTOMER SERVICE STANDARDS
Engineers agree to:
• arrive on time where reasonably possible;
• act professionally and courteously;
• perform services with reasonable skill and care;
• comply with health and safety requirements;
• keep customers informed of delays;
• maintain a professional appearance.
Repeated complaints may result in suspension or removal from the platform.

7. PAYMENTS
Jobsub will collect payments from customers.
Engineer payments will be processed through Stripe or another payment provider approved by Jobsub.
Jobsub reserves the right to deduct:
• agreed booking fees;
• platform fees;
• administration charges;
• refunds attributable to Engineer fault;
• chargebacks or payment disputes.
Payment schedules may be amended by Jobsub upon reasonable notice.

8. CANCELLATIONS AND NON-ATTENDANCE
Engineers must honour accepted bookings.
Where an Engineer:
• fails to attend;
• repeatedly cancels jobs;
• arrives significantly late without reasonable explanation; or
• abandons a booking,
Jobsub may:
• withhold payment;
• suspend access to future jobs;
• remove the Engineer from the platform; and/or
• recover losses suffered by Jobsub.

9. QUALITY OF WORK
Engineers are solely responsible for:
• workmanship;
• materials supplied by them;
• technical advice provided;
• compliance with trade regulations;
• guarantees or warranties they provide.
Engineers shall rectify defective work at their own expense where reasonably required.

10. DAMAGE TO CUSTOMER PROPERTY
The Engineer is solely responsible for any damage caused to a customer’s property, premises, fixtures, fittings, or belongings as a result of the Engineer’s negligence, poor workmanship, actions, omissions, tools, equipment, or conduct.
Where such damage occurs, the Engineer shall be liable for the cost of repair, replacement, refund, compensation, insurance claim, legal cost, or any other loss suffered by the customer or Jobsub.
The Engineer agrees to indemnify Jobsub against any claims, losses, costs, or expenses arising from damage caused by the Engineer.

11. INSURANCE
The Engineer must maintain adequate insurance including:
• public liability insurance;
• professional indemnity insurance where appropriate;
• vehicle insurance where applicable.
Proof of insurance must be supplied upon request.

12. NON-CIRCUMVENTION
The Engineer agrees not to directly solicit, accept work from, or enter into arrangements with any customer introduced by Jobsub outside of the Jobsub platform.
This restriction applies during the Engineer’s relationship with Jobsub and for 24 months following the last completed booking with that customer.
Where this clause is breached, Jobsub reserves the right to recover:
• lost fees;
• administrative costs;
• legal costs; and
• damages arising from the breach.

13. CONFIDENTIALITY
Engineers shall keep confidential all:
• customer information;
• pricing information;
• business processes;
• software access credentials;
• trade information obtained through Jobsub.
This obligation continues after termination.

14. DATA PROTECTION
Engineers agree to comply with applicable data protection legislation.
Customer information supplied through Jobsub shall only be used for completing authorised bookings.
Customer information must not be copied, sold, shared, or retained beyond what is reasonably necessary.

15. REVIEWS AND RATINGS
Jobsub may collect customer feedback and ratings.
Engineers acknowledge that ratings may influence future job allocations.
Jobsub reserves the right to suspend or remove Engineers who consistently receive poor feedback.

16. INTELLECTUAL PROPERTY
The Jobsub app, software, branding, logos, systems, processes, and materials remain the exclusive property of Jobsub Ltd.
Engineers may not copy, modify, distribute, reverse engineer, or exploit any Jobsub intellectual property.

17. LIMITATION OF LIABILITY
Jobsub shall not be liable for:
• loss of earnings;
• loss of business opportunities;
• indirect or consequential losses;
• customer disputes;
• delays outside its control;
• acts or omissions of customers.
Jobsub’s total liability shall not exceed the fees retained by Jobsub relating to the specific booking giving rise to the claim.

18. SUSPENSION AND TERMINATION
Jobsub may immediately suspend or terminate an Engineer’s account where:
• these Terms are breached;
• insurance lapses;
• fraudulent activity is suspected;
• customer safety is compromised;
• repeated complaints are received;
• the Engineer damages Jobsub’s reputation.
Termination may occur without notice where necessary to protect customers or Jobsub.

19. GOVERNING LAW
These Terms shall be governed by the laws of Gibraltar.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Gibraltar courts.

20. CHANGES TO TERMS
Jobsub reserves the right to amend these Terms at any time.
Continued use of the Jobsub platform after notification of changes constitutes acceptance of the revised Terms.

21. ACCEPTANCE
By selecting the “I Agree” checkbox, creating an account, accepting a booking, or continuing to use the Jobsub platform, the Engineer confirms acceptance of these Terms & Conditions.
